The Waste Framework Directive1 requires Member States to take the necessary measures to ensure that waste management is carried out without endangering human health and without harming the environment.

The Commission is aware of asbestos waste resulting from the operation of the former Salonit factory in Vranjic, but has not previously received information about related impacts on the municipal beach of Kosica.

The Commission treats as a priority cases where EU law is not correctly, or not at all, transposed into national legislation, or where fundamental freedoms or key EU law principles are affected in a significant manner. The Commission also prioritises cases that involve persistent and widespread issues of bad application of EU law2.

In that respect, the Commission opened on 24 September 2021 an infringement against Croatia due to its systemic failure to correctly apply the Landfill Directive4 and Waste Framework Directive5.

As regards individual cases of possible incorrect application not raising systematic failure to comply with EU law, the national administrative and judicial bodies are primarily responsible for ensuring that EU legislation is respected. These authorities are better placed and have the necessary territorial proximity to assess situations such as the one described by the Honourable Member.
