September infringement package – main decisions

The EU Commission is adopting a package of infringement decisions due to the absence of communication by Member States on measures transposing EU directives into national law. Member States concerned have two months to reply to the Commission’s “letters of formal notice” and complete their transposition. Otherwise, the Commission may decide to issue a “reasoned opinion” as next legal step to enforce EU laws.

The EU Commission has approved the acquisition of joint control of TBX NewCo Spain S.L.U. of Spain and TBX Upstream Seamless Pipes L.L.C. of the UAE by Tubacex S.A. of Spain and Mubadala Investment Company P.J.S.C. (‘Mubadala’) of the UAE. The transaction relates primarily to the manufacture of oil country tubes for the exploration and extraction of oil and gas.

Russia: EU Council prolongs individual sanctions for a further six months

The EU Council decided today to prolong the restrictive measures targeting those responsible for undermining or threatening the territorial integrity, sovereignty and independence of Ukraine for another six months, until 15 March 2025. The measures provide for travel restrictions, the freezing of assets, and a ban on making funds or other economic resources available to the listed individuals and entities.

EU General Court confirms restrictive measures against Russian company NSD

According to the EU General Court, NSD failed to demonstrate that the EU Council erred in finding that that undertaking was a systemically important financial institution in Russia’s financial system. The Court also points out that NSD provides financial services of significant value both to the Russian Government and the Russian Central Bank, enabling Russia in its financial resources with the aim of pursuing its actions to destabilise Ukraine.

Energy Security: EU Commission and IEA announce new support for Ukraine (updated)

The IEA and the EU presented today ten key energy actions to help safeguard Ukraine’s fragile energy security through the coming winter and beyond. 80% of Ukraine’s thermal plants have been destroyed, and a third of its hydropower capacity. “So this is where we will concentrate our repair efforts, with the aim of restoring 2.5 gigawatts of capacity this winter. That is approximately 15% of Ukraine’s needs” – EU Commission President von der Leyen.
