Urteil des Gerichtshofs in der Rechtssache C‑113/22 TGSS (Verweigerung der Mutterschaftszulage)
Ungleichbehandlung auf Grund des Geschlechts
Dem Vater von zwei Kindern wurde mit Wirkung vom 10. November 2018 eine Rente wegen dauernder Invalidität zuerkannt.
2019 erließ der Gerichtshof ein Urteil (C-450/18) in dem er feststellte, dass das Unionsrecht in Bezug auf die Verwirklichung des Grundsatzes der Gleichbehandlung von Männern und Frauen im Bereich der sozialen Sicherheit dahin auszulegen ist, dass es einer nationalen Regelung entgegensteht, die für Frauen, die zwei oder mehr leibliche oder adoptierte Kinder hatten und von einer Untergliederung des Systems der nationalen sozialen Sicherheit eine beitragsbezogene Rente wegen dauernder Invalidität erhalten, einen Anspruch auf eine Rentenzulage vorsieht, während Männer, die sich in der gleichen Situation befinden, keinen solchen Anspruch haben.
Anlässlich dieses Urteils hat die zuständige spanische Behörde ein Rundschreiben veröffentlicht in dem es heißt, dass Renten wegen dauernder Invalidität, solange die entsprechende Änderung der besagten Regelung nicht erfolgt, weiterhin, wie bisher, ausschließlich Frauen zuerkannt werden, die die dort festgelegten Voraussetzungen erfüllen.
Der Vater stellte 2020 einen Antrag auf Zuerkennung der Mutterschaftszulage. Dieser wurde abgelehnt.
Hiergegen erhob er bei einem erstinstanzlichen Gericht Klage. Dieses sprach ihm den Anspruch auf die Zulage zu; es sei ihm jedoch keine Entschädigung zuzusprechen, da keine Diskriminierung festgestellt werden könne. Hiergegen erhoben sowohl der Vater als auch die Behörde Klage vor dem vorlegenden Gericht.
Dieses möchte vom Gerichtshof wissen, ob die im Rundschreiben genannte Praxis eine Diskriminierung aufgrund des Geschlechts darstellt.
