The Single Resolution Fund (SRF) is an emergency fund that can be used in times of crisis to prevent bank failures. It is financed by the banking sector itself through pooled contributions at national level: each year, credit institutions in the 21 countries that make up the EU Banking Union pay an annual fee. The amount of these ex ante contributions is based on a component linked to size and risk.

In 2021, the Single Resolution Board (SRB) has set the amount of ex ante contributions owed by several credit institutions based in France and Germany (these banks are contesting those amounts and seeking their annulment before the Court of First Instance. They consider, among other things, that the SRB has failed to comply with its obligation to state reasons with regard to the determination of the annual target level for the 2021 contribution period.

The banks have challenged the SRB’s decision at the General Court.

Berechnung der Beiträge für 2021 zum Einheitlichen Abwicklungsfonds

Der Einheitliche Abwicklungsausschuss (Single Resolution Board, SRB), eine im Rahmen des Einheitlichen Abwicklungsmechanismus (Single Resolution Mechanism, SRM) eingerichtete Agentur der Europäischen Union, legt jährlich die im Voraus erhobenen Beiträge von rund 3 500 Finanzinstituten zum Einheitlichen Abwicklungsfonds (Single Resolution Fund, SRF) fest, der 2014 geschaffen wurde. Diese Beiträge werden von den nationalen Abwicklungsbehörden bei den Instituten erhoben und an den SRF übertragen.

Mit Beschluss vom 14. April 2021 legte der SRB die im Voraus erhobenen Beiträge für 2021 fest.

Die oben genannten Institute haben diesen Beschluss vor dem Gericht der EU angefochten, das heute seine Urteile verkündet.
