EU Court Judgment in Case C-319/22 Gesamtverband Autoteile-Handel (Access to information on vehicles)

EU law obliges car manufacturers to make available to independent operators, including repairers, parts distributors and publishers of technical information, the information necessary for the repair and maintenance of the vehicles they manufacture.
A German trade association for the independent parts trade considers that neither the form nor the content of the information provided by the HGV manufacturer Scania to its members meet this obligation. In order to remedy this situation, the association brought the matter before a German court. Uncertain as to the scope of Scania’s obligations, this court in turn referred the matter to the Court of Justice. It wishes to know, among other things, whether the vehicle identification number should be considered as personal data that manufacturers are obliged to communicate.

Zugang zu Kfz-Reparatur- und Wartungsinformationen
Der deutsche Gesamtverband Autoteile-Handel ist der Auffassung, der schwedische Nutzfahrzeughersteller Scania habe gegen EU-Marktverhaltensregeln verstoßen, indem er keinen maschinenlesbaren und elektronisch verarbeitbaren Zugang – sondern nur einen manuellen – zu Informationen über die Reparatur und Wartung bereitstelle.
Scania ist der Ansicht, nur einen manuellen Zugang bereitstellen zu müssen, der auf der Webseite nur eine manuelle Recherche durch einen menschlichen Nutzer am Bildschirm ermöglicht und das Abfrageergebnis auf den sichtbaren Inhalt von Bildschirmseiten beschränkt.
Das Landgericht Köln hat den Gerichtshof hierzu um Vorabentscheidung ersucht.

Information regarding which advertising is presented to you and how you interact with it can be used to determine how well an advert has worked for you or other users and whether the goals of the advertising were reached. For instance, whether you saw an ad, whether you clicked on it, whether it led you to buy a product or visit a website, etc. This is very helpful to understand the relevance of advertising campaigns.
- You have clicked on an advertisement about a “black Friday” discount by an online shop on the website of a publisher and purchased a product. Your click will be linked to this purchase. Your interaction and that of other users will be measured to know how many clicks on the ad led to a purchase.
- You are one of very few to have clicked on an advertisement about an “international appreciation day” discount by an online gift shop within the app of a publisher.
