(Restrictive measures – Ukraine)

Since 2014, the European Union has adopted restrictive measures against Russia due to its annexation of Crimea as well as the city of Sevastopol, and its ongoing destabilising actions in eastern Ukraine. Following Russia’s attack on Ukraine on February 24, 2022, the Council prohibited, among other things, all Russian-registered aircrafts from landing in, taking off from, or flying over EU territory. The same ban also applies to any aircraft not registered in Russia that is owned, chartered, or otherwise controlled by a Russian natural or legal person, entity or body.

The European Commission and the European Aviation Safety Agency (EASA) understand the latter prohibition in so far as it also prohibits anyone with Russian nationality from flying privately as a pilot, since it controls when and where the aircraft flies. The Civil Aviation Authority of the Grand Duchy of Luxembourg referred to this interpretation in a reply sent to the applicant.

Holding a Luxembourg private pilot’s license and using aircraft at Luxembourg-Findel airport, the applicant, a Russian and Luxembourg national, is challenging the Council’s ban before the General Court of the European Union.

Restriktive Maßnahmen angesichts der Situation in der Ukraine

Am 28. Februar 2022 beschloss der Rat der EU angesichts der Situation in der Ukraine restriktive Maßnahmen gegenüber den Sektoren Finanzen und Luftfahrt zu verhängen.

Mitgliedstaaten seien verpflichtet worden, Luftfahrzeugen, die von russischen Luftfahrtunternehmen betrieben werden, in Russland registrierten Luftfahrzeugen und nicht in Russland registrierten Luftfahrzeugen, die im Eigentum einer russischen juristischen oder natürlichen Person stehen oder von ihr gechartert oder anderweitig kontrolliert werden, die Erlaubnis zu verweigern, in ihrem Hoheitsgebiet zu landen, von ihrem Hoheitsgebiet zu starten oder ihr Hoheitsgebiet zu überfliegen.

Frau Islentyeva, eine russische und luxemburgische Staatsangehörige, hat gegen diese restriktiven Maßnahmen vor dem Gericht der EU eine Klage erhoben.Sie möchte ihre Privatpilotenlizenz auf dem Hoheitsgebiet der Europäischen Union nutzen.
