General Court Judgment in Case T-827/22 Wizz Air Hungary v Commission (TAROM II; Covid-19)

TAROM is a Romanian airline operating mainly from Henri-Coandă International Airport in Bucharest, 97.22% of which is owned by the Romanian State.

On February 3, 2022, Romania notified individual aid of €1,908,872 in the form of a capital increase for the Romanian airline TAROM. This aid is financed from Romania’s general budget. The purpose of the measure is to compensate TAROM for damage suffered on fourteen specific international routes during the period from July 1 to December 31, 2020 as a result of travel restrictions linked to the pandemic.

On April 29, 2022, the Commission deemed this aid to be compatible with the internal market without opening a formal investigation procedure.

Wizz Air seeks the annulment of that decision and an order that the Commission pay the costs, on the grounds of incorrect application of Article 107(2)(b) TFEU, errors of assessment as to the proportionality of the measure, breach of the principles of non- discrimination, freedom to provide services and freedom of establishment, failure to initiate a formal investigation procedure, and breach of the obligation to give reasons.

Staatliche Beihilfen für die rumänische Fluglinie Tarom

Mit Beschluss vom 29. April 2022 billigte die Kommission eine staatliche Beihilfe Rumäniens in Form einer Kapitalerhöhung im Umfang von 1,9 Mio. Euro für die staatseigene Fluglinie Tarom. Diese Beihilfe sollte Schäden ausgleichen, die Tarom im zweiten Halbjahr 2020 aufgrund von Reisebeschränkungen im Zusammenhang mit der Covid-19-Pandemie entstanden sind.

Die ungarische Fluglinie Wizz Air hat diesen Kommissionsbeschluss vor dem Gericht der EU angefochten. Sie macht u.a. geltend, dass die Kommission die Verhältnismäßigkeit der Beihilfe falsch beurteilt habe. Die Kommission hätte die Beihilfe zudem nicht genehmigen dürfen, ohne ein förmliches Prüfverfahren zu eröffnen.

Zur Erinnerung: Mit Beschluss vom 2. Oktober 2020 hatte die Kommission eine staatliche Beihilfe Rumäniens zugunsten von Tarom in Form einer Kreditgarantie in Höhe von 19,3 Mio. Euro gebilligt. Damit sollten Schäden ausgeglichen werden, die Tarom aufgrund von pandemiebedingten Flugbeschränkungen von März bis Juni 2020 entstanden sind. Wizz Air focht diesen Beschluss vor dem Gericht der EU an, jedoch ohne Erfolg: Mit Urteil vom 18. Oktober 2023 wies das Gericht die Klage ab (T-332/21).
