EU Advocate General: Opinion in Case C-553/24 Assemblée nationale v EU Parliament and Council

A minority of members of the Assemblée nationale de la République française (the National Assembly of the French Republic), one of the chambers of the French Parliament, has brought an action before the Court of Justice on the basis of the first paragraph of article 8 of Protocol No. 2. (Protocol No. 2 to the TEU and TFEU on the application of the principles of subsidiarity and proportionality ensures that EU institutions respect these principles as laid down in Article 5 TEU.)
They seek the annulment of Regulation (EU) 2024/1351 on asylum and migration management in its entirety, or in the alternative, the annulment of Part IV of that regulation, which concerns solidarity. Regulation (EU) 2024/1351 introduces a mandatory solidarity mechanism to support Member States in addressing situations of migratory pressure.
In the view of the National Assembly, it does this by establishing a regime for the relocation of applicants for international protection to the detriment of the sovereignty, national identity, integrity of their constitutional structures and the security of the Member States, which are obliged to receive on their territory non-EU-country nationals who are the subject of the relocation measures.
The National Assembly, supported by Hungary, argues therefore that this regulation infringes the principle of subsidiarity. The Parliament and the Council, supported by
Greece, Spain and the Commission, challenge the admissibility of most of the claims put forward by the National Assembly. They submit that an action brought under Article 8 of Protocol No 2 can only relate to the principle of subsidiarity.

Nichtigkeitsklage gegen Verordnung 2024/1351 über Asyl- und Migrationsmanagement
Die französische Nationalversammlung hat vor dem Gerichtshof eine Nichtigkeitsklage gegen die Verordnung (EU) 2024/1351 des Europäischen Parlaments und des Rates vom 14. Mai 2024 über Asyl- und Migrationsmanagement erhoben.
Nach Ansicht der Nationalversammlung geht die Verordnung über die Befugnisse der EU hinaus und verstößt gegen das Subsidiaritätsprinzip.
Sie schaffe ein System der „Übernahme“ der internationalen Schutz beantragenden Personen zum Nachteil der Souveränität, der nationalen Identität, der Unversehrtheit der verfassungsmäßigen Strukturen und der Sicherheit der Mitgliedstaaten.
Außerdem lasse die Berechnungsmethode des Finanzbeitrags die Aufnahmekapazität, die Sozialpolitik, die Identität der Völker und die Sicherheitssituation des Landes unberücksichtigt.
