On June 23, 2020, Austria notified the Commission of an aid measure in the form of a subordinated loan (convertible into a grant) of €150 million in favour of Austrian Airlines (AUA), which together with other airlines, such as Brussels Airlines, Swiss International Air Lines et Edelweiss Air, forms part of the Lufthansa group. The purpose of the measure was to compensate AUA for the damage caused from the cancellation or rescheduling of its flights due to the Covid-19 pandemic.

By decision of 6 July 2020, the Commission approved this aid.

Ryanair and Laudamotion unsuccessfully challenged the Commission’s decision before the General Court of the European Union (T-677/20, see also press release 125/21). By its judgment dated July 14, 2021, the General Court dismissed their action. In particular, it found that the aid in question, when deducted from the subsidies granted by Germany to the Lufthansa group in the same context, did not constitute overcompensation in its favour.

Ryanair and Laudamotion appealed against the judgment of the General Court of to the Court of Justice.

Covid-19-Beihilfen Österreichs zugunsten von Austrian Airlines

Mit Beschluss vom 6. Juli 2020 billigte die Kommission eine Beihilfe Österreichs zugunsten von Austrian Airlines in Form eines nachrangigen Darlehens, das in eine Subvention in Höhe von 150 Mio. Euro umgewandelt werden konnte. Damit sollten Austrian Airlines die Schäden ersetzt werden, die ihr durch die Annullierung oder die Verschiebung von Flügen infolge der Covid-19-Pandemie entstanden sind.

Ryanair und Laudamotion haben diesen Beschluss vor dem Gericht der EU angefochten, ohne Erfolg: Mit Urteil vom 14. Juli 2021 wies das Gericht ihre Klage ab und bestätigte somit den Kommissionsbeschluss. Die Beihilfe stelle keine Überkompensation zugunsten der Lufthansa Group dar, der Austrian Airlines angehört. Sie sei nämlich von den Subventionen, die Deutschland dieser Gruppe in demselben Kontext gewährt hatte, abgezogen worden (siehe Pressemitteilung Nr. 125/21).

Ryanair und Laudamotion verfolgen ihr Anliegen weiter im Wege eines Rechtsmittels vor dem Gerichtshof. Ohne Schlussanträge.
