Société du Tour de France is challenging the Decision of the Second Board of Appeal of The European Union Intellectual Property Office (EUIPO) of July 11, 2022 in Case
R 1136/2019-2 (the contested decision), related to the application for European Union figurative mark TOUR DE X.
On May 22, 2017, the intervener, FitX Beteiligungs GmbH, submitted to the EUIPO an application for registration of an EU trade mark for the following figurative sign:
The mark applied for designated goods and services falling within Classes 25 (Clothes, shoes, headgear) 28 (Games, toys, video game machines, sports equipment…) and 41 (Sports education services, training, entertainment services, sporting and cultural activities) as defined in the Nice Agreement concerning the international classification of goods and services for the purposes of the registration of marks.
On August 11, 2017, Société du Tour de France filed its opposition to the registration of the mark applied for the goods and services referred to in the above-mentioned classes, on the basis of prior rights.
Société du Tour de France brought an action before the General Court against EUIPO’s contested decision, asking the General Court to annul it.

Die deutsche FitX Beteiligungs GmbH beantragte 2017 beim Europäischen Amt für Geistiges Eigentum (EUIPO), das Zeichen als Unionsmarke einzutragen, und zwar u.a. für Kleidungsartikel, Spiele, Sportgeräte sowie Trainingsangebote.
Das französische Unternehmen Tour de France erhob dagegen Widerspruch, wofür es sich auf seine älteren Marke Tour de France berief.
Das EUIPO wies den Widerspruch zurück. Es konnte weder eine Verwechslungsgefahr erkennen noch eine Ausnutzung des guten Rufs der älteren Marken.
Das Unternehmen Tour de France hat diese Entscheidung vor dem Gericht der EU angefochten, das heute sein Urteil verkündet.

An unrelated video sharing platform will recommend five other videos on rowing that may be of interest to you when you use your TV app, based on a profile built about you when you visited those different websites to watch online videos.
Information regarding which advertising is presented to you and how you interact with it can be used to determine how well an advert has worked for you or other users and whether the goals of the advertising were reached. For instance, whether you saw an ad, whether you clicked on it, whether it led you to buy a product or visit a website, etc. This is very helpful to understand the relevance of advertising campaigns.
- You have clicked on an advertisement about a “black Friday” discount by an online shop on the website of a publisher and purchased a product. Your click will be linked to this purchase. Your interaction and that of other users will be measured to know how many clicks on the ad led to a purchase.
- You are one of very few to have clicked on an advertisement about an “international appreciation day” discount by an online gift shop within the app of a publisher.
