Judgment in Case C-333/21 European Superleague Company

(Competition)

In 2021, several football clubs proposed to organise a new independent football competition.

Fédération internationale de football association (FIFA) and Union of European Football Associations (UEFA) refused to recognise the European Superleague, stating that any of their players or clubs who participated in it would be banned from competing in FIFA or UEFA events.

The European Superleague company deemed these acts to be contrary to EU competition law and brought proceedings before the Madrid Commercial Court.

The Spanish court requested a preliminary ruling from the Court of Justice as to whether these provisions breached EU competition law and/or infringed the fundamental freedoms of movement, workers and establishment under the EU Treaties.

In December 2022, Advocate General Rantos delivered an Opinion, suggesting that the Court find that UEFA and FIFA’s acts were compatible with EU law, stating that EU competition rules do not prohibit organisations restricting competition where such restrictions are proportionate in achieving the legitimate objectives of the promotion of sport.

Gründung der European Super League

Die European Superleague Company hat vor dem Handelsgericht Nr. 17 von Madrid Klage auf Feststellung erhoben, dass die UEFA und die FIFA dadurch, dass sie sich der Gründung der European Super League widersetzen, als Kartell handeln und ihre beherrschende Stellung auf dem Markt der Veranstaltung internationaler Wettbewerbe für Fußballvereine in Europa und auf dem Markt der Kommerzialisierung der mit diesen Wettbewerben verbundenen Rechte missbrauchen.

Das Handelsgericht hat dem Gerichtshof hierzu um Auslegung des EU-Wettbewerbsrechts sowie der vier Grundfreiheiten (Arbeitnehmerfreizügigkeit, Niederlassungsfreiheit, freier Dienstleistungsverkehr und freier Kapitalverkehr) ersucht.

Generalanwalt Rantos hat in seinen Schlussanträgen vom 15. Dezember 2022 die Ansicht vertreten, dass die FIFA/UEFA-Regeln, die jeden neuen Wettbewerb von einer vorherigen Genehmigung abhängig machen, mit dem Wettbewerbsrecht der Union vereinbar seien (siehe Pressemitteilung Nr. 205/22).
