OLAF report on Frontex – EU Commission Answer

1. The Commission notes that according to Article 10(3) of Regulation (EU, EURATOM) 883/2013¹, information transmitted or obtained by the European Anti-fraud Office (OLAF) in the course of its investigations is confidential. However, the Commission understands that access to OLAF final report has been given to the European Parliament, in a way that respects the applicable data protection and confidentiality requirements, as indicated in a letter sent by OLAF to the Chair of the Committee on Budgetary Control (CONT) on 10 June 2022.

2. and 3. The Executive Director of the European Border and Coast Guard Agency (Frontex) resigned with immediate effect on 28 April 2022. As a result, in the exercise of its powers under Article 100(2)(n) of the founding Regulation of Frontex² (hereinafter: the Regulation), assigning to the Management Board the disciplinary authority over the Executive Director, the Board decided, on 29 April 2022, not to launch further proceedings against him in connection with the OLAF report of 15 February 2022. The Commission is committed to continue playing its role in any developments in the framework of its membership in the Management Board.
