The hearing will take stock of EU investment policy twelve years after becoming an exclusive EU competence with the Lisbon Treaty. It will kick off with a keynote speech delivered by DG Trade’s Deputy Director General, María Martín-Prat. Subsequently, two panels will look at different aspects of the subject.

The first panel (speakers: Mr Ben Butters, EUROCHAMBRES Chief Executive Officer and Ms Nathalie Bernasconi-Osterwalder, IISD Europe Executive Director) will examine the main achievements and challenges of EU investment policy. The panellists will also address the question of whether the EU’s investment policy has delivered on its objectives, including the promotion of sustainable development.

The second panel will cover the state of play and the way forward on investment protection policy and dispute settlement. The speakers (Ms Anna Joubin-Bret, Secretary of the United Nations Commission on International Trade Law and Dr Jan KleinheisterkampAssociate Professor of Law, LSE Law School) will discuss whether the EU’s approach to investment protection is still fit for purpose. The discussion will also focus on the prospects of the ongoing efforts to reform investor-state dispute settlement (ISDS) and the EU’s proposal for a Multilateral Investment Court (MIC).
