EU Judgment in Case C-650/22 FIFA
(Freedom of movement for persons)
A former professional footballer is challenging the rules governing contractual
relations between players and clubs. The rules in question, entitled ‘Regulations on the Status and Transfer of Players’ (RSTP), were adopted by the Fédération Internationale de Football Association (FIFA) – an association responsible for organising football competitions at world level.
These rules that are implemented both by FIFA and by its member national football associations apply, among other things, to a situation where there is a dispute between a player and a club as to a termination of a contract without just cause. In such cases, that player and any club wishing to employ him are jointly and severally liable for any compensation due to his former club.
The player and the new club are also liable to sporting and financial sanctions in case of non-compliance. Furthermore, the association to which the player’s former club belongs may refuse to deliver an International Transfer Certificate to the new association where the player’s new club is registered as long as the dispute with the former club is standing.
The professional football player had signed for the Russian football club Lokomotiv Moscow only to see that contract terminated by this club one year later for an alleged breach “and termination of contract without just cause”.
Lokomotiv Moscow applied to the FIFA Dispute Resolution Chamber for compensation and the player submitted a counterclaim seeking compensation of unpaid wages. The player claims that the search for a new club proved to be difficult because, under the RSTP, any new club would be held jointly and severally liable with himself to pay any compensation due to Lokomotiv Moscow.
He claims that a potential deal with Belgian club Sporting du Pays de Charleroi fell through because of the RSTP conditions and he sued FIFA and URBSFA (the governing body for Belgian football) before a Belgian court for damages and loss of earnings of €6 million.

Urteil des Gerichtshofs in der Rechtssache C-650/22 FIFA
Transfer von Fußballspielern
Ein Fußballspieler, der früher bei Lokomotiv Moskau spielte, hat die FIFA und den belgischen Fußballverband vor den belgischen Gerichten auf Schadensersatz verklagt. Er macht geltend, dass die FIFA-Transfer-Regeln seine Suche nach einem neuen Verein erheblich erschwert hätten und ihm dadurch ein Schaden in Höhe von 6 Mio. Euro entstanden sei. Nur der Verein Sporting du pays de Charleroi habe ihm ein Angebot unterbreitet.
Die FIFA-Transfer-Regeln sehen vor, dass ein Spieler und sein neuer Verein gesamtschuldnerisch zur Zahlung der Entschädigung verpflichtet sind, die dem Verein zusteht, dessen Vertrag mit dem Spieler ohne triftigen Grund aufgelöst wurde. Darüber hinaus sehen sie ein Verbot für den neuen Verein vor, einen Berufsspieler zu registrieren, der seinen alten Vertrag ohne triftigen Grund aufgelöst hat, und erlauben es dem ehemaligen Verein, den für die Registrierung erforderlichen internationalen Freigabeschein (ITC) nicht auszustellen, wenn es zwischen diesem Verein und dem Spieler zu einer Vertragsstreitigkeit über die Auflösung des alten Vertrags kommt.
Zwischen dem hier in Rede stehenden Fußballspieler und Lokomotiv Moskau war zu einer solchen Streitigkeit gekommen. Sie endete während der Suche des Spielers nach einem neuen Verein damit, dass die Kammer zur Beilegung von Streitigkeiten der FIFA dem Spieler auferlegte, Lokomotiv Moskau eine Entschädigung in Höhe von 10,5 Mio. Euro zu zahlen. Zwei Monate nach dieser Entscheidung wurde der Fußballspieler von Olympique de Marseille verpflichtet.
Das mit dem Rechtsstreit zwischen dem Fußballspieler und der FIFA sowie dem belgischen Fußballverband befasste Berufungsgericht Mons möchte vom Gerichtshof wissen, ob die streitige FIFA-Transfer-Regeln mit der Arbeitnehmerfreizügigkeit und dem EU-Kartellverbot vereinbar sind.
Generalanwalt Szpunar hat in seinen Schlussanträgen vom 30. April 2024 die Ansicht vertreten, dass sich die streitigen FIFA-Regeln als mit den unionsrechtlichen Vorschriften über den Wettbewerb und die Freizügigkeit unvereinbar erweisen könnten (siehe Pressemitteilung Nr. 78/24).
