Judgment in Case T-361/21 Papouis Dairies and Others v Commission

On April 5, 2012, several Cypriot companies and organisations operating in the cheese production sector applied to the Cypriot authorities to register the name “Χαλλούμι” (Halloumi/”Hellim”) as a Protected Designation of Origin (PDO). This application was based on the standard providing that halloumi may be produced from ewe’s or goat’s milk, or a mixture of both, with or without cow’s milk, and sought to have this standard interpreted as requiring halloumi producers to use more than 50% ewe’s or goat’s milk.

Subsequent to the registration of this denomination by the Commission, three standard amendments were made to its specifications.

Papouis Diairies Ltd, established in Nicosia (Cyprus), and five other organisations seek the annulment of the Commission Implementing Regulation (EU) 2021/591, registering the name “Χαλλούμι” (Halloumi)/”Hellim” (PDO) in the register of protected designations of origin and protected geographical indications, and the annulment of the three standard amendments to the specification.

Streit um die geschützte Ursprungsbezeichnung „Halloumi“

Im April 2021 trug die Kommission auf Antrag Zyperns Halloumi als EU-weit geschützte Ursprungsbezeichnung für diesen zyprischen Käse ein. Zypern hatte in seinem Antrag präzisiert, dass der Anteil von Schafs- und/oder Ziegenmilch über dem von Kuhmilch liegen müsse, d.h. mehr als 50 % ausmachen müsse.

Angesichts dieser strengen Herstellungsvorgaben beanstanden verschiedene zyprische Hersteller von Halloumi, die diesen Käse unter der Unionskollektivmarke Halloumi vermarkten, diese Eintragung als geschützte Ursprungsbezeichnung vor dem Gericht der EU, das heute sein Urteil verkündet.
