EU Judgment in Case C-255/21 Reti Televisive Italiane

Reti Televisive Italiane SpA (“RTI”) is an Italian audiovisual media services company, owner of the TV channels Canale 5, Italia 1, and Rete 4.
In 2017, the Autorità per le Garanzie nelle Comunicazioni (“AGCOM”) imposed penalties on RTI for violating national legislation on the broadcasting of television advertising, having breached the maximum hourly limit on advertising space.
To calculate the hourly broadcasting time devoted to advertising, AGCOM took into account the promotional messages of radio station R101 broadcast on the television channels owned by RTI.
This radio station, like RTI, is part of the Mediaset group of companies. As a result, RTI argues that Radio R101’s promotional messages should be qualified as self- promotional messages (i.e. messages advertising its own programs) and, consequently, excluded from the hourly broadcasting time for television advertising.
The reference for a preliminary ruling of the referring court concerns the interpretation of the Audiovisual Media Services Directive – Directive 2010/13/EU, as amended by Directive (EU) 2018/1808.
The Italian Council of State, the referring court, asked by RTI to annul the sanctions, asked the Court whether the notion of self-promotional messages broadcast by television with regard to its own programs also covered promotional messages for a radio station belonging to the same group of companies.

Höchstsendezeiten für Fernsehwerbung
Die italienische Rundfunkaufsicht wirft der Sendergruppe Reti Televisive Italiane (RTI) vor, gegen die im italienischen Recht vorgesehenen Höchstsendezeiten für Fernsehwerbung verstoßen zu haben. Bei der Berechnung der Sendezeiten bezog sie Werbung ein, mit der auf drei Fernsehsendern der RTI-Gruppe – nämlich „Canale 5“, „Italia 1“ und „Rete 4“ – der ebenfalls zu dieser Gruppe gehörende Radiosender „R101“ beworben wurde.
RTI hat die Bescheide der italienischen Rundfunkaufsicht vor einem italienischen Verwaltungsgericht angefochten. Nach Ansicht von RTI betrafen die Hinweise ihrer drei Fernsehsender nämlich nur die Präsentation von Sendungen von „R101“ und hätten daher als Hinweise auf eigene Sendungen eingestuft werden müssen, die nicht in die stündliche Höchstsendezeit für Werbung eingerechnet werden dürften.
Das Verwaltungsgericht wies die Klagen von RTI ab, da nach seiner Auffassung Hinweise auf Sendungen eines Hörfunkveranstalters nicht Hinweise auf „eigene Sendungen“ eines Fernsehveranstalters sein könnten, auch wenn der Hörfunkveranstalter zur selben Unternehmensgruppe gehöre wie der Fernsehveranstalter. RTI legte daraufhin Berufung beim italienischen Staatsrat ein. Dieser hat den Gerichtshof um Auslegung der EU‑Richtlinie über audiovisuelle Mediendienste ersucht.
Generalanwältin Kokott hat in ihren Schlussanträgen vom 13. Juli 2023 die Ansicht vertreten, dass Hinweise eines Fernsehveranstalters auf Sendungen oder Programme eines Hörfunkveranstalters grundsätzlich nicht unter den Begriff der „Hinweise des Fernsehveranstalters auf eigene Sendungen“ fallen.
