DESCRIPTION:On 7 October 2026\, BEREC will present the key developments from its recent work and provide insights into future regulatory priorities. \nBEREC’s 2027 Work Programme: consultation with stakeholders\nDuring the event\, BEREC will present its draft 2027 Work Programme and launch a public consultation\, inviting stakeholders to provide their views and contribute to the development of BEREC’s priorities for the year ahead. The public consultation will offer stakeholders an opportunity to engage with BEREC’s planned activities and provide input on the areas of work that will guide its regulatory analysis and initiatives next year. \nEurope’s connectivity and telecommunications markets in a global perspective\nThe public debriefing will also provide insights into BEREC’s analysis of the European Union’s standing in the global telecommunications landscape. BEREC’s comparative analysis examines where the EU stands in terms of connectivity\, network quality\, performance and pricing compared with other jurisdictions. The analysis includes an objective overview of the key elements of the competitive context of telecommunications markets in Europe. \nThe analysis covers a range of areas\, including the deployment of fixed and mobile high-capacity broadband networks\, the supply of services\, the financial performance of telecommunications operators and different regulatory approaches across markets. \nFor its analysis\, BEREC has collected\, analysed and compared data from several countries\, taking into account data availability\, the reliability of sources and variations between markets. SUMMARY:EU Court reviews air traffic management ruling on airline passenger compensation
DESCRIPTION:Thursday\, 8th October 2026 \nJudgment in Case C-108/26 RX D (Decision on air traffic management)\n(Reference for a preliminary ruling – Review – Transport – Compensation andassistance to passengers) \nIn July 2023\, a passenger was due to travel from Izmir (Turkey) to Warsaw (Poland). \nHer flight arrived more than three hours late. The aircraft had previously operated another flight between Katowice (Poland) and Izmir and had itself been delayed following an air traffic management decision. This decision was linked to airspace restrictions in Hungary and Romania\, which had been put in place due to adverse weather conditions. Furthermore\, after the aircraft arrived in Izmir\, a technical fault was detected and it took more than two hours to repair it. \nAs the passenger had assigned her right to compensation to a specialist company\, the latter is claiming compensation of €400 from the air carrier. \nThe Polish court hearing the case found that\, if the time lost due to air traffic management were deducted from the total delay\, the flight from Izmir to Warsaw would have arrived less than three hours late\, meaning that the passenger would not be entitled to compensation. It therefore seeks to ascertain under what conditions a decision relating to the management of such traffic may constitute an ‘extraordinary circumstance’ within the meaning of EU law\, which could exempt the carrier from the obligation to pay compensation. \nIn its judgment of January 21\, 2026\, the General Court of the European Union held that such a decision is not inherent in the normal course of an air carrier’s business and that\, in principle\, it is beyond the carrier’s effective control\, regardless of the reasons behind it\, unless the carrier contributed to its adoption. According to the General Court\, it is the decision itself\, and not its grounds\, that is decisive\, in so far as it is the decision that externally affects the operation of the flight. Consequently\, the General \nCourt held that such a decision may constitute an ‘extraordinary circumstance’ even where it did not\, on its own\, result in a delay of at least three hours. \nOn a proposal from the First Advocate General\, the Court of Justice decided to partially review the General Court’s judgment on the grounds of a serious risk of undermining the unity or consistency of EU law \nBackground Documents C-108/26 RX \n  \n\nDonnerstag\, 8. Darüber hinaus wurde nach der Ankunft des Flugzeugs in Izmir ein technischer Defekt festgestellt\, dessen Behebung mehr als zwei Stunden dauerte. \nD\, eine auf Forderungseinzug spezialisierte Gesellschaft\, macht den an sie abgetretenen Anspruch auf eine pauschale Ausgleichszahlung gegen das durchführende Luftfahrtunternehmen geltend. \nDas damit befasste polnische Gericht hat festgestellt\, dass der Flug von Izmir nach Warschau eine Verspätung von weniger als drei Stunden gehabt hätte\, wenn der Zeitverlust\, der sich aus den Maßnahmen der Verkehrsflussregelung ergeben habe\, von der Gesamtdauer der Verspätung abzuziehen sei. Es möchte daher wissen\, ob Entscheidungen über die Zuweisung verspäteter Zeitnischen als „außergewöhnliche Umstände“ im Sinne der EU-Fluggastrechteverordnung eingestuft werden können. \nIn seinem Urteil vom 21. Januar 2026\, D (Entscheidung des Flugverkehrsmanagements) (T‑134/25\, EU:T:2026:35) hat das Gericht der Europäischen Union darauf geantwortet\, dass die Entscheidung des Flugverkehrsmanagements einen „außergewöhnlichen Umstand“ darstellen könne\, sofern erwiesen sei\, dass diese Entscheidung vom betreffenden Luftfahrtunternehmen nicht tatsächlich beherrschbar war\, insbesondere wenn ausgeschlossen werden könne\, dass das Luftfahrtunternehmen zum Erlass der Entscheidung beigetragen hat. Ein Luftfahrtunternehmen könne eine Entscheidung des Flugverkehrsmanagements\, die einen vorangegangenen Flug betroffen hat\, den es selbst mit demselben Flugzeug durchgeführt hat\, als „außergewöhnlichen Umstand“ im Sinne dieser Bestimmung geltend machen\, sofern ein unmittelbarer ursächlicher Zusammenhang zwischen dem Auftreten dieses Umstands und der Verspätung oder Annullierung des später von ihm durchgeführten Fluges bestehe. \nNach der Entscheidung der Überprüfungskammer des Gerichtshofs\, das genannte Urteil zu überprüfen und nach den Schlussanträgen des Generalanwalts Norkus vom 10. DESCRIPTION:Thursday\, 8th October 2026 \nJudgment in Case C-482/24 P Global 8 Airlines v Commission\n(Common foreign and security policy) \nAs part of the restrictive measures adopted following Russia’s military aggression against Ukraine\, the EU has\, amongst other things\, prohibited certain aircraft linked to Russian persons or entities from landing on\, taking off from or flying over its territory. \nGlobal 8 Airlines\, a Kyrgyz airline\, has acquired two aircraft from a Russian company. \nAfter Eurocontrol rejected a flight plan for one of those aircraft\, the airline learnt that they were included on a list of aircraft subject to a flight ban provided to Eurocontrol by the European Commission. \nGlobal 8 Airlines applied to the General Court to annul the decision to include its aircraft on that list. \nIn April 2024\, the General Court dismissed its application as inadmissible\, holding that that decision did not constitute an act against which an action for annulment could be brought. \nGlobal 8 Airlines has lodged an appeal against the judgment of the General Court. \nBackground Documents C-482/24 P \n  \n\nDonnerstag\, 8. Oktober 2026 \nUrteil des Gerichtshofs in der Rechtsmittelsache C-482/24 P Global 8 Airlines / Kommission\nRestriktive Maßnahmen: Flugverbot für nicht in Russland registrierte Luftfahrzeuge in der EU \nGlobal 8 Airlines\, eine Gesellschaft kirgisischen Rechts\, deren Eigentümer und Geschäftsführer lettische Staatsangehörige sind\, erwarb von einem russischen Unternehmen\, deren Anteilseigner russische Staatsangehörige sind\, zwei leichte Geschäftsflugzeuge. Im März 2023 wurde der Gesellschaft von der Kommission mitgeteilt\, dass beide Flugzeuge in eine Liste von Luftfahrzeugen aufgenommen wurden\, die einem Verbot der Landung\, des Starts oder des Überflugs des Hoheitsgebiets der Union unterliegen. \nGlobal 8 Airlines hat die Aufnahme in die Flugverbotsliste vor dem Gericht der EU angefochten. Mit Beschluss des Gerichts vom 29. April 2024 wurde die Klage als unzulässig abgewiesen. Die Gesellschaft verfolgt ihr Anliegen weiter im Wege eines Rechtsmittels vor dem Gerichtshof. \nGeneralanwalt Campos Sánchez-Bordona hat in seinen Schlussanträgen vom 12. DESCRIPTION:Thursday\,  8th October 2026 \nJudgment in Case C-706/23 Şcoala gimnazială «Mihai Eminescu»\n(Freedom of movement for persons – Freedom of movement for workers – Social policy) \nBetween 2019 and 2022\, fourteen employees working on permanent\, full-time contracts in pre-university educational establishments in Romania also entered into fixed-term\, part-time employment contracts with those establishments. These contracts provided for hourly pay for the period from September to June of each academic year. \nDuring that period\, financial entitlements relating to annual leave and meal allowances were calculated exclusively on the basis of the permanent\, full-time employment contract. \nThe teachers concerned considered that they were also entitled\, in respect of their work paid on an hourly basis\, to annual leave and meal allowances calculated in proportion to the time actually worked. Through their trade union\, they brought proceedings before the Vaslui County Court (Romania)\, which upheld their claim in 2023. \nThe employer appealed against that judgment to the Court of Appeal of Iași (Romania)\, which decided to refer questions for a preliminary ruling to the Court of Justice. \nThe Court of Appeal asks\, in essence\, whether EU law precludes the Romanian legislation which\, in the event of an employee holding multiple contracts\, provides that that employee’s entitlements are to be calculated solely on the basis of their permanent\, full-time employment contract \nBackground Documents C-706/23 \n  \n\nDonnerstag\, 8. Aushilfslehrkräfte einer rumänischen Sekundarschule schlossen zusätzlich zu ihren unbefristeten Vollzeitarbeitsverträgen auch befristete Teilzeitarbeitsverträge auf Stundenlohnbasis mit dieser Schule ab. Daraus leiten sie Ansprüche auf Urlaubsentgelt und Verpflegungszulage in Bezug auf die im Rahmen der befristeten Teilzeitverträge geleistete Tätigkeit ab\, die zusätzlich zu Urlaubsentgelt und Verpflegungszulage im Hinblick auf ihre Vollzeitarbeitsverträge für denselben Zeitraum zu zahlen seien. \nDas in diesem Zusammenhang befasste Berufungsgericht möchte vom Gerichtshof wissen\, ob es mit dem Unionsrecht vereinbar ist\, dass sich die Berechnung von Urlaubsentgelt und Verpflegungszulage ausschließlich auf die Einnahmen aus den unbefristeten Vollzeitarbeitsverträgen bezieht. \nGeneralanwalt Richard de la Tour hat in seinen Schlussanträgen vom 26. März 2026 die Ansicht vertreten\, dass es unzulässig sei\, das im Rahmen des befristeten Teilzeitarbeitsvertrags gezahlte Entgelt nicht in die Berechnung des Urlaubsentgelts einzubeziehen. DESCRIPTION:Thursday\, 8 October 2026 \nJudgment of the Court of Justice in appeal case C-572/25 P Brasserie Nationale and Munhowen v Commission\nBeverage wholesale trade in Luxembourg: acquisition of Boissons Heintz by Brasserie Nationale \nBy decision of 14 March 2024\, the European Commission accepted Luxembourg’s referral request to examine the acquisition of Luxembourg beverage wholesaler Boissons Heintz by Luxembourg-based Brasserie Nationale (through its subsidiary Munhowen) under the EU Merger Regulation. The proposed concentration was not subject to mandatory notification either at EU level or in Luxembourg\, any other EU Member State or an EEA State. \nIn the Commission’s view\, the referral criteria under the EU Merger Regulation were met. In particular\, according to the Commission’s preliminary assessment\, the transaction could affect trade between Member States\, given that Luxembourg imports beverages on a large scale\, and threatened to significantly affect competition in Luxembourg\, as it would combine the country’s two largest beverage wholesalers (see also the Commission’s Daily News MEX/24/1506). \nBrasserie Nationale and Munhowen challenged before the General Court of the European Union the Commission’s decision to examine\, at Luxembourg’s request\, Brasserie Nationale’s (Munhowen’s) acquisition of Boissons Heintz. This will include: \n\nannual reports on the EU budget for 2025 and the European Development Funds\na summary document entitled “2025 EU audit in brief”\na press release\nan infographic sheet\na FAQ page\n\nAbout the annual report\nEach year\, the auditors check the EU accounts and provide their opinion on two questions: whether the accounts are accurate and reliable\, and to what extent there is evidence of money having been received or paid out in error (known as ‘regularity’ and ‘legality’). They publish the results of this work in the ECA’s annual report. \nIn 2025\, EU spending from the EU budget amounted to €176.3 billion\, with a further €40.1 billion spent under the Recovery and Resilience Facility (RRF).  \nBackground information\nThe European Court of Auditors (ECA) is the independent external auditor of the European Union. Its audit reports and opinions are an essential element of the EU’s accountability chain. They are used to hold to account those responsible for implementing EU policies and programmes: the Commission\, other EU institutions and bodies\, and administrations in Member States. \nThe ECA warns of risks\, provides assurance\, indicates shortcomings and good practice\, and offers guidance to EU policymakers and legislators on how to improve the management of EU policies and programmes.​​  \n

DESCRIPTION:Practical information\n\n8 – 9 October 2026\nLocation: Dublin\, Ireland\nOrganiser: Department of Foreign Affairs and Trade\n\nAn informal meeting of EU ministers responsible for development will take place on 8 and 9 October in Dublin. \nThe informal meeting of the Foreign Affairs Council (FAC) in the development format will be hosted by Ireland’s Minister of State for International Development and Diaspora\, Neale Richmond TD. \nEU Ministers will come together to discuss the unprecedented challenges facing development cooperation and to facilitate strategic dialogue on the importance of the EU’s continued work with partner countries as a reliable and principled partner\, building mutually beneficial partnerships. \nThe formal meeting of the FAC (Development) is scheduled to take place on 1 December\, in Brussels. \nOfficial Council meetings are organised by the Council of the EU and chaired by the Council presidency.
