SUMMARY:EU Court rules on Belgian quota limiting non-resident access to medical studies
DESCRIPTION:Thursday\, 1st October 2026 \nEU Judgment in Case C-131/25 Dris\n(Education\, vocational training\, youth and sport – Charterof Fundamental Rights – Non-discrimination and citizenship of the Union) \nAxel Dris\, a Luxembourg national residing in Luxembourg\, completed his secondary education in Arlon\, a Belgian border town. \nIn 2022\, he passed the entrance examination for medical studies in Belgium. However\, because he was classified as a non-resident student\, he was subject to the quota limiting the number of such students who may enrol in medical studies in the French Community of Belgium. In view of his ranking\, he was not issued the certificate required to enrol and challenged that decision. \nHearing the dispute\, the Belgian Council of State asked the Court of Justice whether EU law\, in particular the rules on non-discrimination and the free movement of EU citizens\, the right to education and the provisions concerning EU action in the field of education\, precludes a quota limiting access to medical studies for non-resident students. That quota is intended to maintain the quality of medical services and education and to protect public health\, given the large proportion of non-resident students who leave Belgium after completing their medical training. \nBackground Documents C-131/25 \n  \n\nDonnerstag\, 1. Außerdem sollte eine hohe Betreuungsqualität während der Ausbildung und der Schutz der öffentlichen Gesundheit gewährleistet werden. \nEin Luxemburger\, der in Luxemburg wohnt\, seinen Schulabschluss aber im benachbarten Belgien gemacht hatte\, erreichte bei der Zulassungsprüfung keinen ausreichend hohen Ranglistenplatz\, um die für die Einschreibung an einer französischsprachigen medizinischen Fakultät in Belgien erforderliche Bescheinigung über die erfolgreiche Teilnahme zu erhalten. SUMMARY:EU Court rules on suspension of asylum claims during temporary protection
DESCRIPTION:Thursday\, 1st October 2026 \nEU Judgment in Case C-249/25 Jilin\n(Area of Freedom\, Security and Justice– Borders\, asylum and immigration) \nIn March 2022\, UB\, a Chinese national of Uyghur origin\, arrived in the Netherlands with his Ukrainian wife and their child. He subsequently lodged an application for asylum there. \nThe Netherlands authorities granted him temporary protection as a family member of a Ukrainian national who had been residing in Ukraine before February 24\, 2022 and suspended the examination of his asylum application until that protection expired. \nIn 2024\, UB requested that the examination of his asylum application be resumed but received no reply. He therefore brought an action for failure to act before the District Court of The Hague\, which ordered the Netherlands authorities to take a decision on his application. \nHearing the case on appeal\, the Netherlands Council of State asked the Court of Justice whether EU law (notably Council Directive 2001/55/EC on minimum standards for giving temporary protection in the event of a mass influx of displaced persons and Directive 2013/32/EU on common procedures for granting and withdrawing international protection) permits a Member State automatically to suspend the examination of an asylum application lodged by a beneficiary of temporary protection\, with the result that the time limit for deciding on that application does not resume until the temporary protection period has expired. \nBackground Documents C-249/25 \n  \n\nDonnerstag\, 1. Oktober 2026 \nUrteil des Gerichtshofs in der Rechtssache C-249/25 Jilin\nAussetzung der Prüfung von Anträgen auf internationalen Schutz von Personen\, die vorübergehenden Schutz genießen \nEin chinesischer Staatsangehöriger\, der erklärt\, von 2009 bis 2014 und von 2018 bis Februar 2022 in der Ukraine gewohnt zu haben\, reiste zusammen mit seiner ukrainischen Ehefrau\, mit der er einen Sohn hat\, in die Niederlande ein und stellte im April 2022 einen Asylantrag. Nach der Feststellung\, dass für ihn vorübergehender Schutz in Betracht komme\, wurde sein Asylantrag nicht weiter bearbeitet. Der Klage des chinesischen Staatsangehörigen mit der Begründung\, über seinen Asylantrag sei nicht fristgerecht entschieden worden\, hat das erstinstanzliche Gericht stattgegeben. Hiergegen hat der zuständige Minister Berufung beim niederländischen Staatsrat eingelegt. \nIn diesem Zusammenhang hat der Staatsrat den Gerichtshof um Vorabentscheidung zu der Frage ersucht\, wie die Entscheidungsfrist bei einem Asylantrag zu bestimmen ist\, der von einer Person gestellt wurde\, der vorübergehender Schutz gewährt wurde. Er möchte wissen\, ob die Mitgliedstaaten die Bearbeitung eines Antrags auf internationalen Schutz einer Person\, die vorübergehenden Schutz genießt\, für den Zeitraum des vorübergehenden Schutzes aussetzen können. \nGeneralanwalt Campos Sánchez-Bordona hat in seinen Schlussanträgen vom 16. SUMMARY:EU Advocate General considers GDPR right to erase data from baptismal registers
DESCRIPTION:Thursday\, 1st October 2026 \nEU Advocate General Opinion in Case C-12/25 Bisdom Gent\n(Charter of Fundamental Rights – Principles of Union law– Protection of personal data) \nA Belgian national who was baptised as a Catholic as a child asked the Diocese of Ghent to remove any reference to him from all physical or digital registers or archives. He relied on the General Data Protection Regulation (GDPR). \nThe Diocese subsequently recorded his withdrawal from the Church in the baptismal register. Dissatisfied with this approach\, the person concerned lodged a complaint with the Belgian Data Protection Authority. The Authority ordered the Diocese to erase the person’s personal data. \nThe Diocese challenged that decision before a Belgian court. That court referred a number of questions to the Court of Justice. In particular\, it asks whether a person who was baptised as a minor and who\, after reaching adulthood\, wishes to distance himself from the Roman Catholic Church has the right to have his personal data erased from the baptismal register. \nBackground Documents C-12/25 \n  \n\nDonnerstag\, 1. Diese wies das Bistum an\, die personenbezogenen Daten des Betroffenen zu löschen. \nDas Bistum focht diese Entscheidung vor einem belgischen Gericht an. SUMMARY:EU Advocate General considers managers’ liability for corporate cartel fines
DESCRIPTION:Thursday\, 1 October 2026 \nOpinion of the Advocate General at the Court of Justice in Case C-347/25 Zapp\nLiability of company directors for cartel fines \nThe managing director of a German limited liability company (GmbH)\, who was also a member of the management board of a public limited company (AG)\, both belonging to a group of companies active in stainless steel production\, participated in a price-fixing cartel involving steel companies. \nAs a result\, the German Federal Cartel Office (Bundeskartellamt) imposed a fine of €4.1 million on the GmbH and a fine of €126\,000 on the managing director. \nThe GmbH and the AG are seeking reimbursement from the managing director of the fine imposed on the GmbH\, as well as compensation for €1 million in IT and legal costs incurred by the AG in defending itself against the fine. They also seek a declaration that the person concerned is liable to compensate them for any further losses arising from the cartel infringement. They argue that\, by participating in the cartel arrangements\, he breached his duties as managing director and member of the management board. \nThe German Federal Court of Justice (Bundesgerichtshof – BGH)\, hearing the dispute\, asks the Court of Justice whether the prohibition of cartels under EU law precludes a national rule under which an undertaking fined for an infringement of competition law may seek reimbursement of that fine from its managing directors or management board members (see also BGH press release No 31/2025). \nAdvocate General Szpunar delivers his Opinion today. \nFurther information \nThis English translation is provided for informational purposes only. Oktober 2026 \nSchlussanträge des Generalanwalts am Gerichtshof in der Rechtssache C-347/25 Zapp\nGeschäftsführerhaftung für Kartellbußgelder \nDer Geschäftsführer einer GmbH\, zugleich Vorstandsmitglied einer AG\, die zu einer in der Edelstahlproduktion tätigen Unternehmensgruppe gehören\, beteiligte sich an einem Preiskartell unter Stahlunternehmen. \nDas deutsche Bundeskartellamt verhängte deswegen Bußgelder gegen die GmbH in Höhe von 4\,1 Mio. Euro und gegen den Geschäftsführer in Höhe von 126.000 Euro. \nDie GmbH und die AG verlangen vom Geschäftsführer die Erstattung des gegen die GmbH verhängten Bußgelds sowie Ersatz für der AG zur Abwehr des Bußgelds entstandene IT- und Anwaltskosten in Höhe von 1 Mio. Euro. Darüber hinaus begehren sie die Feststellung\, dass der Betroffene ihnen alle weiteren Schäden zu ersetzen hat\, die aus dem Kartellverstoß folgen. Der Betroffene habe durch seine Beteiligung an den Kartellabsprachen seine Pflichten als Geschäftsführer und Vorstandsmitglied verletzt. \nDer mit dem Rechtsstreit befasste Bundesgerichtshof (BGH) möchte vom EuGH wissen\, ob das unionsrechtliche Kartellverbot einer nationalen Regelung entgegensteht\, nach der ein Unternehmen\, gegen das ein Bußgeld wegen eines Kartellrechtsverstoßes verhängt worden ist\, seine Geschäftsführer oder Vorstandsmitglieder dafür in Regress nehmen kann (siehe auch BGH-Pressemitteilung Nr. 31/2025). \nGeneralanwalt Szpunar legt heute seine Schlussanträge vor. \nWeitere Informationen \n
